Ocala Pride Inc. Volunteer Agreement The following agreement details the terms for all volunteers working for Ocala Pride Inc. in relation to any of its scheduled events: 1. OCALA PRIDE INCORPORATED (OPI) contracts for the Volunteer(s) and as such, are not to be considered employee(s). Volunteer(s) agrees to serve the needs of OPI in relation to any of its scheduled events as their availability allows. 2. Volunteer(s) will be allowed reasonable access to facilities used for any event before and after the event for the purpose of assembling and removing equipment etc. Volunteer(s) will arrive at the engagement on time for their assigned duties and are expected to remain until their assigned duties are fulfilled. Volunteer(s) remaining longer than 4 hours will be given periodic breaks and mealtimes as needed. 3. Volunteer(s) shall reimburse, indemnify, and hold harmless OPI for all loss to PUBLIC OR PRIVATE PROPERTY resulting from the negligence of Volunteer(s) in the performance of their assignment. In further consideration, Volunteer(s) hereby agrees to assume all liability, jointly and severally, for any injuries or damages that may be assignment related, or that Volunteer(s) or its employees/contractors may cause to any persons or property during the Volunteer(s) use while Volunteer(s) is engaged in the activities hereinabove. OPI shall not be liable for any damages or injuries of the Volunteer(s), their employees, contractors or their equipment, while on PUBLIC or PRIVATE premises, and Volunteer(s) hereby releases OPI, its Executive Board, Board of Directors, Officers, and Members from all form and manner of risks inherent or relating to such activities, and agrees to waive all claims and demands of any nature arising from said assignment or related activities, except for those losses or claims arising from the sole or willful negligence of OPI. 4. OPI will provide all necessary tools, equipment, supplies, wares, etc. that Volunteer(s) may use to accomplish their assignment. At the end of their assignment, all tools, equipment, supplies, unsold wares, or any other property of OPI are to be returned to the care of OPI. Volunteer will be liable for any damage or loss of OPI property. OPI is not responsible for any additional equipment/property Volunteer(s) may choose to bring either for their personal use or for use in furtherance of their assignment. 5. Volunteer(s) may not engage in any form of promotion or sales unrelated to OPI unless Volunteer(s) has also filled out a corresponding application or received special permission from the board of directors. Volunteer(s) who are given such permission may only do so after they have completed, or during breaks from, their assignment. Volunteer(s) who have filled out applications for other purposes or received special permission are still responsible for fulfilling their respective agreements 6. Only those items or services specifically delineated in this agreement are being provided or paid for by OPI. No additional costs or services will be borne by OPI without its prior expressed written consent. 7. Volunteer(s) shall not discriminate in any manner against any entertainer, member, applicant for membership or attendee because of race, age, color, gender/gender identity, sexual orientation, nationality, ethnicity, physical or mental handicap, marital status, political affiliation, or religion. 8. If in OPI's sole determination, Volunteer(s) or their employees appear on or near the event site noticeably under the influence of alcoholic beverages, narcotics, drugs, or other controlled substances, or exhibit behavior, conduct or acts that would reflect negatively upon OPI or are socially unacceptable as determined by OPI, or its staff, OPI shall have the right to terminate this agreement and/or trespass and have the offenders removed from the premises with no liability on the part of OPI. Volunteer(s) shall be liable to OPI for payment within thirty (30) days after demand of all of OPI's costs, expenses, damages, and claims resulting from such cancellation, including reasonable attorney's fees and costs incurred in the enforcement of this provision. Volunteer(s) acknowledges that no weapons of any kind, alcoholic beverages, narcotics, drugs, or other controlled substances or their related paraphernalia are permitted on or to be consumed on City Property on or around the performace site. Non-alcoholic beverages as requested by Volunteer(s) should be provided if separately agreed to in writing by OPI and Volunteer(s). 9. Volunteer(s) acknowledge that each of them will be sensitive to the commonly accepted local standards of civility and conduct incidental to their performances. 10. OPI may modify this agreement provided written notice no less than 48 hours in advance of the event is given to Volunteer(s). Absent such modifications, the parties will be responsible only for those items expressed in this agreement and any rider(s)/addendums attached thereto, irrespective of any additional or contrary oral or written statements or representations. 11. In the event any of the provisions of this agreement are rendered to be invalid, illegal or unenforceable for any reason, the remainder of this agreement shall remain in full force and effect and shall be binding on the parties hereto. 12. The validity, interpretation and effort of this agreement and any Addendum attached thereto shall be governed by the laws of the State of Florida. The laws of the State of Florida shall govern all rights, obligations, remedies, and liabilities arising pursuant to this agreement and any rider(s) attached thereto. Venue for any legal action relating to this agreement shall be Marion County, Florida.
