RENTAL AGREEMENT Capital City E-Bike Rental Date: __________________________ This Rental Agreement ("Agreement") is entered into between Capital City E-Bike Rental ("Company") and the undersigned customer ("Customer") for the rental of an electric bicycle ("e-bike"). By signing this Agreement, the Customer acknowledges and agrees to the following terms and conditions: 1. Rental Period The standard rental period is 3 hours unless otherwise agreed upon in writing at the time of rental. The rental period begins at the time the e-bike is rented and ends when the e-bike is returned to Capital City E-Bike Rental. Late returns will incur additional charges as specified in the Company’s rental policies. 2. Condition of the E-Bike The e-bike is provided in good working condition. The Customer agrees to inspect the e-bike prior to use and report any pre-existing damage or defects to the Company. The Customer is responsible for maintaining the e-bike in the same condition during the rental period, excluding normal wear and tear. 3. Customer Responsibility The Customer agrees to use the e-bike in accordance with all local laws, regulations, and the safety instructions provided by the Company. - Accidents and Mechanical Failures: The Company is not responsible for accidents or mechanical failures such as flat tires, broken chains, or other incidents caused by the normal use of the e-bike. - Prohibited Uses: The e-bike must not be used for stunts, off-road riding, or other reckless activities. - Theft or Loss: In the event of theft or loss of the e-bike, the Customer agrees to pay the full retail price of the specific bike rented. Retail prices vary based on the model rented and will be specified in the rental agreement at the time of signing. - Damage Beyond Repair: If the e-bike is damaged beyond repair due to the Customer’s actions or negligence, the Customer agrees to pay the full retail price of the specific bike rented. 4. Exclusions for Damages The Customer is not responsible for damages caused by: - Flat tires. - Broken chains. - Accidents that do not result in significant damage to the e-bike. 5. Damage Assessment and Charges If the e-bike is returned with damage, the Company will assess the extent of the damage. The Customer agrees to pay for the repair costs as determined by the Company. If the e-bike is beyond repair, the full retail price of the specific bike rented will be charged. 6. Retail Price Disclosure At the time of rental, the Customer will be informed of the retail price of the specific e-bike rented, and the price will be included in the signed rental agreement. 7. Assumption of Risk The Customer acknowledges that riding an e-bike carries inherent risks, including the risk of injury or property damage. The Customer assumes all risks associated with the use of the e-bike. 8. Indemnification The Customer agrees to indemnify and hold harmless Capital City E-Bike Rental, its owners, employees, and agents from any claims, damages, or liabilities arising from the use of the e-bike. 9. Return Policy The Customer must return the e-bike at the end of the rental period in the same condition in which it was rented, excluding normal wear and tear. Failure to return the e-bike may result in additional fees or legal action. 10. Governing Law This Agreement shall be governed by the laws of the state of Michigan.
